The rules of the road (specifically Rule 17: Action by Stand-on Vessel) state that the stand-on vessel shall maintain its course and speed, but it may take action to avoid collision as soon as it becomes apparent that the give-way vessel is not taking appropriate action. However, the foundational requirement for any action, by either vessel, is that a risk of collision (Rule 7) must first exist. Without a risk of collision, no avoiding action is required or permitted under the rules.
